1. Introduction

These Terms & Conditions (“Terms”) govern your use of the PragiGreens website and your purchase of plants, nursery products, and other products offered by PragiGreens. The website is operated by PRAGI GREENS PRIVATE LIMITED. By using the website or placing an order, you agree to these Terms.

2. Products and Product Information

We make reasonable efforts to display product descriptions, images, sizes, quantities, prices, and other information accurately. Plants are living products and may naturally vary in colour, shape, size, foliage, growth, and appearance from product photographs. Such natural variation does not by itself constitute a defect.

Product availability is subject to change. We may limit quantities or discontinue products where necessary.

3. Orders and Acceptance

An order placed through the website is a request to purchase the selected products. An order is considered accepted when PragiGreens confirms it according to its applicable order process. We reserve the right to cancel or decline an order in cases such as product unavailability, pricing or listing errors, suspected fraud, delivery limitations, or other legitimate operational reasons.

4. Prices and Payments

Prices displayed on the website are in Indian Rupees unless otherwise stated. Applicable taxes, delivery charges, discounts, and other charges will be shown during checkout where applicable. Orders must be paid using the payment methods made available on the website.

Where a refund is approved, the refund may be processed through the applicable payment method or payment provider and may be subject to provider processing timelines.

5. Delivery

We will make reasonable efforts to dispatch and deliver orders within the estimated delivery period shown at checkout or communicated for the order. Delivery timelines may be affected by courier operations, weather, address issues, serviceability, force majeure events, or other circumstances outside our reasonable control.

The customer is responsible for providing an accurate and complete delivery address and being reasonably available to receive the order.

6. Plant-Specific Delivery Inspection and Return Policy

Because PragiGreens deals in living plants and nursery products, any request to return a product because of damage, visible condition, wrong product, or another delivery-related issue must be raised at the time of delivery, before the delivery is accepted or immediately while the delivery agent is present.

The customer should inspect the package and product at the doorstep. If the customer identifies a qualifying issue, the customer must immediately inform the delivery person and contact PragiGreens through the available support channel, preferably with clear photographs or video evidence.

Once the product has been accepted and the delivery has been completed, the product will not be eligible for return under the doorstep inspection/return policy. This restriction is necessary because plants are living products and their condition can change after delivery due to handling, environment, watering, temperature, sunlight, or other post-delivery factors.

Nothing in this section limits any mandatory consumer rights or remedies that cannot legally be excluded under applicable law.

7. Refunds and Cancellations

Order cancellation and refund eligibility will depend on the order status, payment status, product status, and applicable policy. If a refund is approved, the amount and processing method will be communicated as applicable.

A shipment cancellation and an order cancellation/refund are separate operational actions and may be subject to different conditions.

8. Damaged or Incorrect Product at Delivery

If a product arrives visibly damaged, materially different from the ordered product, or otherwise appears to have a qualifying delivery issue, the customer should raise the issue at the doorstep immediately. PragiGreens may request photographs, video, packaging details, order information, or other reasonable evidence before deciding the appropriate resolution.

9. Customer Responsibilities

Customers must provide accurate contact and delivery information, ensure someone is available to receive the order, inspect plant products at delivery, follow reasonable care instructions, and avoid misuse of the website or services.

Customers must not attempt to interfere with website security, submit fraudulent orders or claims, or use the website for unlawful purposes.

10. Account and Website Use

Where an account is created, you are responsible for keeping your login credentials reasonably secure and for activity performed through your account. We may suspend or restrict accounts where we reasonably believe there is fraud, misuse, security risk, or violation of these Terms.

11. Intellectual Property

The PragiGreens name, website content, product content, logos, graphics, text, and other materials provided by PragiGreens are protected by applicable intellectual property laws. They may not be copied, reproduced, modified, or commercially used without appropriate permission, except as permitted by law.

12. Third-Party Services

The website may use third-party services such as payment gateways, logistics providers, hosting services, analytics services, or other technology providers. Their services may be governed by their own terms and policies.

13. Limitation of Liability

To the extent permitted by applicable law, PragiGreens will not be liable for indirect, incidental, special, or consequential losses arising from use of the website or products. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
